PER DIEM COURT APPEARANCE DEPARTMENT




Assignment Guidelines

 

Thank you for considering our firm to help streamline the services offered to your clients.

 

In order to best preserve your firm’s image and our reputation, while providing first rate representation for your clients, we require adherence to the guidelines presented below.

 

If you already have per diem procedures and forms in place, please let us know so that we can best accommodate you.


Please Note: Per diem services are only available to licensed attorneys. Appearance requests made by pro se litigants, real estate brokers, loss mitigation consultants, or other professionals will not be honored.

 


Appearance Requests


Details and documents for court appearances must be received via email to  perdiem@fordelawoffices.com by 6:00pm the evening before the requested appearance date.

 

Subject line of Assignment Email should provide critical information set forth in the following format:


Date – Time – County or City – Court – Index – Judge.


For example: 09/05/20 – 10:00am – Queens – SUPREME – 16-12345 – Lourdes

 


Required Information


The following information should be provided in the body of the Assignment Email:



Relevant Pleadings, Motions, Exhibits and/or Supporting Documentation for appearances should be attached to the Assignment Email in pdf format. Special arrangements must be made for the collection or mailing of documents for submission to the court.

 

Please Note: We will NOT print documents for submission other than a Stipulation to Adjourn. We will NOT print from PACER.

 


Updates


Attorney of record must furnish to appearing attorney the telephone number and email address for a contact person who (a) possesses intimate knowledge of the details of the case and (b) will be readily available and prepared to provide immediate response throughout the duration of the appearance. Contact can be Plaintiff.


Due to varying court regulations regarding the use of technological devices, updates sent on the day of the appearance must be received via email to perdiem@fordelawoffices.com by  8:30am for morning appearances or by 1:00pm for afternoon appearances.

 


Cancellations


Attorney of record is responsible for notifying appearing attorney of any changes or cancellations via email. We will NOT track your cases on eCourts.

 

Please Note: Cancellations must be received no later than 24 hours before time of court appearance. Appearances cancelled <24 hours in advance may be subject to applicable fee.

 


Confirmations


All assignment, update and cancellation emails will be confirmed via an emailed response stating “Received” or “Confirmed.” If you do not receive a response please call 917-370-6901 immediately.

 


Acceptance of Service


Appearing attorney will ALWAYS ACCEPT SERVICE of documents in court. Documents will be scanned into pdf format and emailed to attorney of record within 24 hours.

 

If hard copy is required, request must be made within 72 hours of receipt of pdf. Special arrangements must be made for either Hand Delivery (Nassau & Queens only) or the provision of a Courier Service account number for mailing.

 

Please Note: Documents not requested within 72 hours will be marked for shredding.

 


Reports


In most cases, formal written reports on court appearances will be emailed to attorney of record within 48 hours of conclusion of appearance (by Monday morning for Friday appearances). Notwithstanding, attorney of record will be notified of any time sensitive orders on the same day of appearance.

 

Please Note: Receipt of report after 48 hours will NOT be grounds for non-payment.

 


Anti-Poaching Policy


WE DO NOT POACH CLIENTS. Attorney of record will be notified of any direct contact between your client and appearing attorney. (Per diem intermediaries should note that a “client” is defined as the referring paralegal or attorney, NOT the entire firm.)

 


Service Areas


We make appearances in ALL courts in Kings, Nassau, New York, Queens counties. Suffolk County, Bronx County and White Plains appearances are assessed a surcharge. Appearances made in Federal Bankruptcy Courts located at Cadman Plaza and Central Islip.


Sorry, we DO NOT make appearances in Westchester or Richmond Counties.

  


Fee Schedule & Payment Policy


Please email accounting@fordelawoffices.com to request a fee schedule.


Payments due within 28 days of date of invoice.
